🏛️ Supreme Court Quashes Expulsion of Legislature Member
SUNIL KUMAR
SINGH vs BIHAR LEGISLATIVE COUNCIL
The Hon’ble Supreme
Court of India, in a Division Bench judgment, has quashed the expulsion of the Petitioner
from the Bihar Legislative Council, holding the punishment to be disproportionate and excessive.
⚖️ Held: The Court clarified that Article 212(1)
bars Constitutional Courts from reviewing legislative proceedings for
procedural irregularities only. However, it does not preclude judicial review of the legality or constitutionality of
legislative actions, including lawmaking and administrative decisions.
🖋️ Judgment authored by: Justice Kant
📌 Key Takeaway:
This ruling reinforces the balance between legislative
privilege and judicial oversight, ensuring that the legislature’s
actions remain subject to constitutional scrutiny.
